Before making any contact with a student-athlete, a person must register with the West Virginia Secretary of State’s Office and the West Virginia University Department of Intercollegiate Athletics.
The following are not permissible by the NCAA, WVU, and/or the State of West Virginia (this is not an all inclusive list; please refer any questions you may have to the Compliance Office):
An agent, runner, or financial advisor cannot agree verbally or in writing to any type of contract with a current student-athlete prior to the completion of the student-athlete’s eligibility at WVU.
An agent or representative cannot agree verbally or in writing with a student-athlete to provide representation in future professional sports negotiations or negotiate on behalf of the current student-athlete with any professional team or league.
A professional sports organization or commercial entity cannot market a student-athlete’s athletic ability or reputation.
An agent or representative cannot provide a payment of money or a benefit to a current student-athlete.
An agent or representative cannot offer money, lend money, or offer any other benefit to any member of the current student-athlete’s family.
An agent may send written materials to current student-athletes, provided that the agent simultaneously sends an identical copy of materials to the West Virginia University Department of Intercollegiate Athletics in care of the Compliance Office.
An athlete agent may contact a current student-athlete, provided that the current student-athlete initiates the contact with the agent and the agent gives prior notice to the West Virginia University Department of Intercollegiate Athletics in care of the Compliance Office.
The Uniform Athlete Agents Act in the State of West Virginia gives WVU the right to sue an agent and former student-athlete for damages suffered by the institution because of any violation of the Act.
